These terms and conditions explain the obligations of Lavendyl Lavender Ltd‘s (Lavendyl/we/our/us) as a service provider and the customer (you/your).  Please read them carefully.  Continuing to use our website signifies that you have read, understood, and agree to be bound by these terms and conditions.

Please note that we may change these terms and conditions without notice. Changes are effective immediately upon posting on this website.  If you do not agree to these terms and conditions please discontinue use of our website and do not enter Lavendyl Lavender Farm.

These terms apply to the entire content on the site, any web feeds produced by the site, and any feedback or submissions provided through the site. By viewing and using the site, you agree to these terms of use.

Disclaimer

Lavendyl Lavender Ltd disclaims and excludes all liability for any claim, loss, demand, or damages of any kind whatsoever (including for negligence) arising out of or in connection with the use of either this website or the information, content, or materials included on this site or on any website we link to.

All intellectual property on the website, including all copyright and trademarks, is our property.  Any unauthorised use of any of our intellectual property is strictly forbidden.

Use of our Website

We make every effort to provide the most accurate information. However, our website may contain technical inaccuracies or typographical errors. We make no claim whatsoever about any other website you may access via our website.

Limitation of Liability

We will not, in any event, be liable to any party for any direct, indirect, special, or other consequential loss or damage arising from the use of our website or any other website accessed from our website.

Social share buttons

We use ‘buttons’ that link to specific social media platforms. We do not own these social media channels and encourage you to read their privacy policy and conditions of use. Please protect your personal information and others by not publishing personal information such as names and addresses.

Adding link sharing of our pages to social media platforms does not imply we endorse these sites. Nor do we imply any obligation on you to share to social media platforms you belong to or have not already joined.

You agree that the laws of New Zealand apply exclusively to these terms and conditions and that the Courts of New Zealand have exclusive jurisdiction over them. You agree not to commence any court action in any other jurisdiction in relation to these terms and conditions and to indemnify us against any costs incurred in respect of your breaching this clause and these terms and conditions.

Visiting Lavendyl in Person

We value your custom and aim to provide a friendly, safe and enjoyable experience. By entering Lavendyl, you accept all the terms and conditions in this document.

Payments 

The business name on your bank /credit card statement will be Lavendyl Lavender. We will charge your account in New Zealand dollars.

Children

Children visiting Lavendyl must, at all times, be supervised by a responsible person aged 16 years or over at a ratio of not more than seven children to each such responsible supervisor.

Car Parking

We provide car parking. You must comply with the car parking signs and instructions set out in the car parking area or given verbally by us. We accept no liability for any damage to any vehicles parked in or otherwise using the car parking area.

Health and Safety

Lavendyl is a working farm offering a variety of activities and attractions. We advise that, while we take all reasonable care, certain risks are present including, but not restricted to;
– Open waterways
– Weather conditions
– Trees
– Wildlife, including the interactive wildlife displays
– Uneven walking surfaces
– Moving vehicles.

You are responsible for avoiding or otherwise mitigating these risks. Appropriate care must be taken throughout your time at Lavendyl and/or while participating in any activity offered by us.

You must not and must not allow accompanying children, to walk or climb on any surface not provided for that activity, such as, but not limited to, fencing, gates, landscaping material, garden beds, and edging. You must not open any closed gates.

By entering Lavendyl you acknowledge and accept personal responsibility and liability for these and any other risks presented by us, and to the maximum extent allowed by the law, you are releasing us and our subsidiaries, employees, agents, and officers from any liability, and indemnify them for any claims, losses, damages or expenses that arise in respect of the matters outlined or alluded to in this clause, including, but not limited to;
– Personal injury or death
– Property loss or damage
– Acts that may be construed as negligent and/or accidental
– Any other loss, harm, damage, or suffering.

Should liability of any kind be attributed to us or our subsidiaries, employees, agents, or officers, such liability is limited to the amount paid for the ticket or admission to Lavendyl by the person to whom we are liable.

Cancellation and Closure

We reserve the absolute right to cancel any service or activity or part of such at Lavendyl, at any time, whether for weather conditions, insufficient bookings, or any other reason. This includes the closure of part of Lavendyl or removal or variation of animals from advertised programs or activities. We will use our reasonable endeavours not to do this. However, should it be necessary, we shall have no liability to any party. We will consider the matter of refunds, whether partial or in full case-by-case and at our absolute discretion.

Tickets

Your ticket to Lavendyl is personal and is not transferrable. Entry to Lavendyl is permitted only with a valid ticket. We have no liability or responsibility for lost tickets.

Your ticket does not allow entry for any commercial purpose.

Drugs, Alcohol, and Smoking

You must not bring any drugs (other than prescribed medications or other medicinal pharmaceuticals) to Lavendyl.

You may only bring alcohol as an accompaniment to a meal. It must be consumed only by you.

Lavendyl is a smoke-free farm.

Unacceptable Behaviour

We reserve the right to deny access to Lavendyl, or to remove from Lavendyl, any person or persons considered to be likely to fail to observe our directions, either signage or by staff, whether holding tickets or not, including people considered to be, or have the potential to be, a nuisance or reckless or disruptive. In such circumstances, we will not give any refund.

Use of Media

Any recording, whether visual, audio or both, taken by you during your visit to Lavendyl or during any activity at Lavendyl, must be for personal use only. Any other use, including any commercial use without our express permission, is strictly prohibited.

Commercial Use

Any person wishing to use the facilities at Lavendyl for commercial purposes must apply in advance to info@lavenderfarm.co.nz.

Product Samples

We provide samples of our product in the shop to enable you to “try before you buy”. Please read our product safety guidelines here.

Contractors

Contractors and anyone conducting commercial activity at Lavendyl need permission. They must sign in and out at the shop upon arrival and departure.

Covid-19

Please do not enter our buildings if you feel unwell or have tested positive for Covid 19. IN the event that we need to cancel pre-booked activities a a result of Covid 19 any fee paid in advance will be refunded.
